Navigating AI Regulation: What UK Businesses Need to Know in 2026

The artificial intelligence landscape is evolving at an unprecedented pace, and with it, the regulatory frameworks that govern how businesses develop, deploy, and use AI systems. For UK businesses, understanding the current regulatory environment is not just a matter of compliance — it is a strategic imperative that will shape competitive positioning for years to come.

The UK government has adopted what it describes as a "pro-innovation" approach to AI regulation. Rather than introducing a single, comprehensive AI Act, the UK has opted for a sector-specific framework, empowering existing regulators such as the FCA, Ofcom, the CMA, and the ICO to apply a set of cross-cutting principles within their respective domains. These principles — safety, transparency, fairness, accountability, and contestability — provide a flexible foundation, but their practical application varies significantly between sectors.

UK businesses that operate in or supply services to the European Union must also contend with the EU AI Act (Regulation 2024/1689), which entered into force in August 2024 and is being implemented in phases through to 2027. The EU AI Act adopts a risk-based classification system, categorising AI systems as minimal risk, limited risk, high risk, or unacceptable risk. High-risk AI systems — including those used in employment decisions, credit scoring, law enforcement, and critical infrastructure — face the most stringent requirements including conformity assessments, quality management systems, and ongoing monitoring obligations.

The extraterritorial reach of the EU AI Act means that many UK businesses will need to comply with both regimes simultaneously. A UK fintech company whose AI-powered credit scoring model is used by EU-based customers must comply with the FCA's Consumer Duty requirements domestically and the EU AI Act's high-risk provisions for its EU operations.

Key compliance steps UK businesses should take now include conducting a comprehensive AI inventory to identify all AI systems in use and under development; carrying out risk assessments against both UK sectoral requirements and the EU AI Act risk classifications; implementing appropriate governance frameworks including documentation, human oversight mechanisms, and transparency measures; and training staff on AI compliance obligations relevant to their roles.

Data governance remains a critical component of AI compliance. The use of personal data in AI training and deployment must comply with UK GDPR, and the ICO has published detailed guidance on AI and data protection that businesses should follow. The ongoing debate around the use of copyrighted material in AI training data introduces further legal considerations, particularly following the UK government's consultation on a text and data mining exception for AI training.
